Terms of Service

These Terms of Service (“Terms”) govern your access to and use of KerfPilot software and our website (the “Service”). By downloading, installing, purchasing, or using the Service, you agree to these Terms.

Who we are

KerfPilot is operated by KerfPilot (“we”, “us”, “our”). Contact: support@kerfpilot.com.

Paid Beta and pre‑release nature

KerfPilot may be offered as a “Paid Beta” (early access / pre‑release). You acknowledge that:

  • features may change, be added, removed, or refined;
  • the Service may contain bugs or limitations;
  • we may release updates at our discretion.

Your purchase grants access to the Paid Beta license tier described on our website at the time of purchase.

License, activation, and restrictions

Unless otherwise stated, your purchase grants you a limited, non‑exclusive, non‑transferable license to install and use KerfPilot on the number of machines permitted by your license file.

License files may be machine‑specific. You must not share, resell, sublicense, publish, or distribute license files, claim links, or unlock keys.

Acceptable use

You agree not to use the Service to:

  • break the law or assist others to break the law;
  • infringe intellectual property rights;
  • reverse engineer, bypass, disable, or defeat licensing or security features (except where this is expressly permitted by law);
  • interfere with or disrupt the Service or its infrastructure.

Customer responsibilities and safety

KerfPilot generates and exports CNC/plasma cutting toolpaths and related settings. You are responsible for verifying outputs before cutting, including but not limited to: cut order, lead‑ins/outs, pierce settings, offsets, kerf, material setup, machine parameters, and safety procedures.

Always perform safe test cuts and follow your machine manufacturer’s instructions. You use KerfPilot at your own risk.

Payments

Payments and checkout are processed by Lemon Squeezy (our merchant of record/payment processor). Your purchase may also be subject to Lemon Squeezy’s terms and policies.

Refunds

Refunds are governed by our Refund Policy. Lemon Squeezy may also issue refunds in certain situations to prevent chargebacks or comply with their policies.

Intellectual property

KerfPilot, the website, and all related content are owned by us or our licensors and are protected by applicable intellectual property laws. No rights are granted except as expressly stated in these Terms.

Disclaimer

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant that the Service will be error‑free, uninterrupted, or meet your requirements.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business arising from or related to your use of the Service.

Where liability cannot be excluded, our total liability will be limited to the amount you paid for the Service in the 3 months preceding the event giving rise to the claim.

New Zealand consumer law

Nothing in these Terms is intended to exclude rights that cannot be excluded under applicable law. Where you acquire the Service for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply (to the extent permitted).

Changes

We may update these Terms from time to time by posting a revised version on our website. The updated Terms apply from the date posted.

Governing law

These Terms are governed by the laws of New Zealand. You submit to the non‑exclusive jurisdiction of the courts of New Zealand.
